UNCONDITIONAL SURRENDER OF THE CITY OF PASSAU, GERMANY

2 May 1945
Passau, Germany

We the undersigned, Karl Sittler, Burgermeister of Passau, Doctor Erwin Brandl, Chief of 15 Army Hospitals with a total of approximately 6,000 soldier patients, Lt. Col., German Army Medical Corps, and Frederick Linbacher, Major, Chief of Police in consideration for the U.S. Army ceasing to fight in our city hereby unconditionally surrender the city of Passau, Germany wirth a total population of 34,000 inhabitants to the Commanding Officer of the 261st Infantry. It is understood and hereby agreed to that the city of Passau and the entire area is now placed under the control of American Military Government.
We and each of us hereby agree to carry out all orders and instructions of Military Government including the surrender of all German soldiers under our control and the surrender of all wapons and explosives. We further agree to use all our efforts in the control of the civilian population to prevent any interference with military operations or military personnel.
The foregoing voluntary entered into 2300 hours this 2d day of May 1945 in Passau, Germany.
